Landlords Must Give You A No Pets Waiver If You Qualify

Persons with disability have equal right to housing as those without disability. Disability can be physiological or emotional or mental. Animals can assist persons with disabilities. A person often faces difficulties if rents housing with ‘no pet’ provision. However, federal laws allow persons with disability to keep an animal in spite of ‘no pet’ provision in the housing. Disabled persons are entitled to logical accommodations under federal laws. Court has held a no pet waiver provision which is a rational accommodation for a disabled person. If a landlord do not allow a service animal in rental housing for a person who qualifies under the laws, then the landlord violates the laws. To qualify, a person must have a qualifying disability. The tenant must request a no pet waiver policy from the landlord and request the accommodation. Service animal is not a pet but you need to notify the landlord before further conversation on rent. Housing regulations and public access regulations are not same.

Laws that allow persons with disability to keep an animal despite ‘no pet’ provision in the housing:


Fair housing amendments Act of 1988, section 504 of the rehabilitation Act of 1973 and Title 2 of American with disabilities Act protect the right of people with disability to keep service animal in spite of landlord’s policy of prohibits pet because service animal is not a ‘pet’. The American disability act does not limit the type of disability even if the service animal is trained by you according to your requirement.

Documents asked by landlords:

Where the landlord has no pet policy in housing, you need to submit a letter requesting a convenient accommodation and making an exception to the rule. Persons with disabilities get service animals but they need to show proper reasons for getting a service animal. The landlord would ask for a proof of disability. A proof that the animal is trained may also require. Landlord can ask for a written copy of examinations by the physician. As long as the tenant has a prescription mentioning disability and animal assistive support, it would allow the support animal in the housing. Law make the landlord to make an exception. It is not compulsory to disclose one’s disability to the landlord. In spite of providing all the required documents, if the landlord tries to terminate someone’s residency, there are criminal penalties as fines or jail time for making false claims. It is always preferable to find a housing that allows and accepts pets happily in order to avoid these hassles.

In spite of the laws landlord may refuse an animal:

Landlord can refuse a service dog based on breed. If a landlord can show that allowing an animal of certain breed in the housing would increase his insurance premier or cause his insurance to discontinue, then the landlord’s refusal is a burden on you. Some landlords are exempt from fair housing amendments Act. The housing law is not applicable in some cases such as buildings with fewer units where one unit is occupied by the landlord, publicly owned and government owned housing, Section 8 housing etc.
